This website is operated by Pompomme (also doing business as KIX and MiniP). Throughout the site, “we,” “us,” and “our” refer to Pompomme / KIX / MINIP. By visiting our site and/or purchasing from us, you agree to these Terms of Service (“Terms”). If you don’t agree, please don’t use the site.

We may update these Terms at any time by posting a new version here. Your continued use of the site means you accept the changes.

Our store is hosted on Shopify Inc., which provides the e-commerce platform we use.

1) Online Store Terms

You represent you’re at least the age of majority in your jurisdiction, or have consent from a parent/guardian for any minor dependents using this site. Don’t use our products or services for any illegal purpose.

2) General Conditions

We can refuse service to anyone, anytime. Content you submit (not including credit cards) may be transferred unencrypted over networks and adapted to technical requirements. Credit card data is always encrypted.

3) Accuracy of Information

We try to keep info current, but it may not always be complete or up to date. Use the site at your own risk. We can change content at any time with no obligation to update prior content.

4) Modifications & Prices

Prices can change without notice. We may modify or discontinue the Service at any time.

5) Products & Availability

Some items may be limited or available online only. Colors and images may display differently by device. We can limit sales by person, region, or order and discontinue products at any time.

6) Orders & Account Info

We may refuse or limit any order (including those using the same account, card, or address). Keep your account, email, and payment info current and accurate.

7) Third-Party Tools & Links

We may offer tools or links from third parties “as-is.” We don’t control them and aren’t responsible for their content, policies, or actions.

8) User Content

If you submit reviews, comments, ideas, or other content, you grant us a non-exclusive, royalty-free license to use, edit, publish, and translate it. Don’t post unlawful, infringing, or harmful content.

9) Errors & Omissions

We may correct errors, inaccuracies, or omissions (including pricing and availability) without notice, including after you submit an order.

10) Prohibited Uses

Don’t use the site to break laws, infringe rights, harass others, transmit malware, scrape data, or bypass security.

11) Shipping, Risk of Loss & Delivery (Important)

• Risk of Loss: Title and risk of loss pass to you when we deliver an order to the carrier (UPS/USPS/other).
  

• Lost/Delayed/Damaged Shipments: We are not responsible for any lost, stolen, misdelivered, delayed, or damaged shipments once the carrier has possession—regardless of reason. Please file claims directly with the carrier.
  

• If your package shows “delivered” but you can’t locate it, check with neighbors/building management and contact the carrier. We can assist with documentation, but replacement or refunds are at our discretion.
  

• If you want added protection, choose insured shipping at checkout (when available).

15) Indemnification

You agree to indemnify and hold harmless Pompomme / KIX / MINIP and our affiliates from claims arising out of your breach of these Terms or your use of the site.

If any part of these Terms is unlawful or unenforceable, the rest remains in effect.

17) Termination

We can suspend or terminate access at any time if you violate these Terms. Your obligations up to termination survive.

18) Governing Law

These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflicts of laws principles.
